Terms and Conditions

I. Definitions

 

Data Controller and the operator of the website www.kuriekuria.com (hereinafter – Seller) is MB “Ludi artis”, company code 306665892, registered address Antagynės g. 40, Kaunas, Republic of Lithuania, email address – info@kuriekuria.com.

Buyer – a capable natural or legal person who has purchased Goods in the online store https://www.kuriekuria.com/

Parties – Buyer and Seller together.

Personal Data – any information related to a natural person – data subject, whose identity is known or can be directly or indirectly determined by such data as a personal code, one or several characteristics inherent to a person of a physical, physiological, psychological, economic, cultural, or social nature.

Goods – everything that is traded in the online store kuriekuria.com. In the Rules, the terms "goods" and "items" mean both singular and plural.

Terms and Conditions of Sale (hereinafter – Rules) regulate the rights and obligations of the Buyer and the Seller, the prices of Goods, payment procedures, terms, delivery, quality guarantee of Goods, return, and exchange of Goods, and responsibilities.

Privacy Policy – a document approved by the Seller that outlines the main rules for the collection, accumulation, processing, and storage of Personal Data when using kuriekuria.com.

 

II. General Provisions

 

These Terms and Conditions of Sale, once confirmed by the Buyer (by reading the Rules and checking the box next to the statement "I have read and agree with the terms and conditions of the website"), are a binding legal document for the Parties, setting out the rights and obligations of the Buyer and the Seller, conditions for purchasing and paying for the Goods, delivery and return procedures, responsibilities of the Parties, and other provisions related to the purchase and sale of Goods in the online store.

The Seller reserves the right to change, correct, or supplement the Rules at any time, taking into account the requirements set by legal acts.

By confirming the Rules, the Buyer confirms that they have the right to purchase goods in the kuriekuria.com online store.

It is also informed that these Rules may be changed due to changes in legal regulation. Each time when ordering Goods, it is recommended to review the Rules to ensure that the Buyer fully understands the conditions under which the order will be placed in each specific case.

The Buyer must familiarize themselves with the Privacy Policy approved by the Seller. The Buyer's consent or disagreement with specific methods of using their Personal Data is expressed in the manner provided in the Privacy Policy.

If the Seller is required or entitled to provide documents or information to the Buyer via email, the Buyer is responsible for providing a valid and working email address.

 

III. Privacy Policy

MB “Ludi artis”, conducting electronic commerce, follows the Law on Legal Protection of Personal Data of the Republic of Lithuania, the General Data Protection Regulation (EU) 2016/679, and other legal acts that regulate the processing, compliance, and implementation of Personal Data.

The Privacy Policy is an integral part of the Rules.

 

IV. Goods

Images of Goods presented in the online store are illustrative. Although the Seller has made every effort to accurately represent the colors of the Goods, the Seller cannot guarantee that the Buyer's device screen will accurately reflect the colors of the Goods. The Buyer understands that Goods may slightly differ from their images.

All Goods presented in the online store are available to the Buyer. If the ordered Goods are out of stock, the Buyer is immediately informed by email or other means (call and/or SMS message), and the order of such Goods is canceled.

The contract between the Buyer and the Seller is considered concluded from the moment the Buyer selects the desired Goods and forms a shopping cart, clicks the "Order" link, and the Seller, after contacting the Buyer via phone or email, confirms the order by sending an email about the order confirmation.

Each purchase and sale contract between the Buyer and the Seller is registered and stored in the online store database.

 

V. Buyer’s Rights

The Buyer has the right to access their Personal Data and request correction of incorrect, incomplete, or inaccurate Personal Data by sending an email to info@kuriekuria.com. In such cases, the Seller must immediately implement the Buyer's request (within 1-2 working days).

The Buyer can exercise the right to withdraw from the purchase and sale contract only if the Goods have not been damaged or their appearance has not substantially changed, and they have not been used and remain in their original packaging.

The Buyer who has purchased a defective Good from the kuriekuria.com online store has the right to demand the Seller to return the Good.

 

VI. Buyer’s Obligations

The Buyer must pay for the Goods and accept them according to these Rules.

If the data provided in the Buyer's order form changes, the Buyer must immediately inform the Seller.

Using the kuriekuria.com online store, the Buyer undertakes to comply with these Rules, other conditions clearly indicated in the online store, and not to violate the legal acts of the Republic of Lithuania.

 

VII. Seller’s Rights

Under important circumstances, the Seller may temporarily or permanently discontinue the operation of the online store without prior notice to the Buyer. In such a case, all accepted and confirmed orders are completed, and new orders are not accepted.

The Seller has the right to cancel the Buyer's order without prior notice if the Buyer, having chosen payment by bank transfer, does not pay for the Goods.

The Seller may conduct various marketing promotions and inform Buyers about these promotions with their prior consent by sending information to the contacts provided by the Buyers. The Seller also has the right to unilaterally, without separate notice, change the conditions of the discussed marketing promotions and terminate the already ongoing promotions.

 

VIII. Seller’s Obligations

The Seller undertakes to provide the Buyer with the opportunity to use the services provided by the online store https://www.kuriekuria.com/ under the conditions specified in these Rules and the online store.

The Seller undertakes to respect the Buyer's right to privacy of their personal information, i.e., to process the Personal Data provided by the Buyer under the procedure established by the laws of the Republic of Lithuania.

The Seller undertakes to deliver the Goods ordered by the Buyer to the specified address under the conditions specified.

When the Buyer returns the Goods, the Seller undertakes to return the money paid within 14 working days from the day the Goods are returned to the Seller.

 

IX. Prices of Goods, Payment Procedure, and Terms

The prices of Goods in the online store and in the formed order are indicated in euros with VAT.

The price of the Goods cannot change after the Seller has confirmed the order, except in cases where the price of the Goods has changed due to a technical error in the information systems or other objective reasons beyond the Seller's control. If in such a case the Buyer does not agree to purchase the Good at the new price, the Buyer can cancel the order by informing the Seller within 2 (two) working days. When the order is canceled in the manner specified in this point, all amounts paid by the Buyer are refunded.

The Buyer pays for the Goods using electronic banking.

The Buyer undertakes to pay for the Goods immediately. Only after payment is received, the order is formed.

Payment can be made using Apple Pay, Google Pay, Swedbank, Seb, Luminor, Citadele, and Šiaulių bankas electronic banking services. Payments can be made in euros. Payments are processed using the Wix Payments payment platform.

The Seller reserves the right to require the Buyer to sign a Goods order contract.

The VAT invoices indicate the selected Goods, their quantity, discounts provided, the final price of the Goods, including all taxes, and other data required by the legal acts regulating accounting.

 

X. Delivery of Goods

The Buyer, when ordering Goods, can choose the method of delivery of the Goods, i.e., use the Seller's Goods collection point.

 

XI. Delivery of Goods to the Address Specified by the Buyer

The Buyer, at the time of ordering, having chosen the Goods delivery service, undertakes to specify the exact place of delivery of the Goods.

The Buyer undertakes to accept the Goods personally. If the Buyer cannot accept the Goods personally, and the Goods are delivered to the specified address and based on other data provided by the Buyer, the Buyer has no right to make claims to the Seller regarding the delivery of the Goods to the wrong subject.

Goods are delivered by the Seller or an authorized representative.

The order can be collected by the person who placed the order or another authorized person presenting the order details.

The Seller delivers the Goods to the Buyer based on the shipping policy indicated in the online store. These terms are preliminary and do not apply when the Seller's warehouse does not have the required Goods, and the Buyer is informed about the shortage of the ordered Goods. Additionally, the Buyer agrees that in exceptional cases, the delivery of Goods may be delayed due to unforeseen circumstances beyond the Seller's control. In such a case, the Seller undertakes to immediately contact the Buyer and agree on the conditions for the delivery of the Goods.

The Seller is not responsible for changes in the properties of the Goods that may occur due to temperature changes or other effects beyond the Seller's control during the delivery of the Goods to the Buyer. The Seller is also not responsible for damage caused during transportation.

In all cases, the Seller is released from liability for violation of the delivery terms of the Goods if the Goods are not delivered to the Buyer or are delivered late due to the Buyer's fault or due to circumstances dependent on the Buyer.

 

XII. Return and Exchange of Goods

Goods purchased at kuriekuria.com are returned and/or exchanged in accordance with Articles 6.362 and 6.363 of the Civil Code of the Republic of Lithuania, the Civil Code of the Republic of Lithuania, and the Rules for the Return and Exchange of Items approved by the Minister of Economy of the Republic of Lithuania on 29 June 2001 by Order No. 217, and other legal acts regulating the return and exchange of Goods.

The Buyer has the right to withdraw from the Goods purchase and sale contract concluded in the kuriekuria.com online store by notifying the Seller in writing (by email, indicating the desired Goods return, and the order number) no later than within 14 (fourteen) days from the delivery date.

When a purchased Good is defective, the Buyer may return it and demand a refund.

When returning Goods, the Buyer must follow the following conditions:

- The returned Good must be in its original, neat packaging;

- The Good must be undamaged by the Buyer;

- The Good must be unused, without losing its commercial appearance (undamaged labels, protective film, etc. – this point does not apply in case of returning a defective Good);

- The returned Good must be in the same configuration as the Buyer received it;

- When returning a Good, it is necessary to present its purchase document (or its copy), warranty document (if issued), and completed return document.

 

The Buyer can return the purchased Good by delivering it to the Goods collection point indicated by the Seller.

 

The Seller has the right not to accept the Goods returned by the Buyer if the Buyer does not comply with the established return procedure.

The money for the returned Goods is always transferred to the payer's bank account, i.e., to the account from which the payment was made.

 

XIII. Responsibilities

The Buyer is fully responsible for the correctness of the data provided in the registration form. If the Buyer does not provide accurate data in the registration form, the Seller is not responsible for the resulting consequences and gains the right to claim direct damages from the Buyer.

The Buyer is responsible for the actions performed using the online store kuriekuria.com.

The Seller is released from any liability in cases where the loss arises from the fact that the Buyer, despite the Seller's recommendations and their obligations, did not familiarize themselves with these Rules, even though such an opportunity was given to them.

If the Seller's online store contains links to websites of other companies, institutions, organizations, or individuals, the Seller is not responsible for the information or activities performed there, does not maintain, control, and does not represent those websites and individuals.

In the event of damage, the guilty Party compensates the other Party for the direct losses.

 

XIV. Sending Information

The Seller sends all notifications to the email address provided in the Buyer's registration form.

The Buyer sends all notifications and questions to the Seller's online store section specified means.

 

XV. Final Provisions

These Rules are formed under the legal acts of the Republic of Lithuania.

All disputes arising from the enforcement of these Rules are resolved through negotiation. If no agreement is reached, disputes are resolved under the procedure established by the laws of the Republic of Lithuania.
